A New Jersey man’s lawsuit against Grubhub and Jersey Mike’s may give new meaning to ordering a sandwich with extra bite.
Fernando Rodriguez sued the food delivery company and sandwich chain in Middlesex County, New Jersey, alleging negligence after he said he found dentures embedded in a Jersey Mike’s sandwich delivered through Grubhub, USA Today reported.
According to the complaint, the April 2025 order was prepared, packaged, sealed and assigned to a Grubhub driver. When it arrived at Mr. Rodriguez’s home, the food appeared sealed with tape, the lawsuit says. But after opening the sandwich and taking a bite, he allegedly discovered the dental hardware inside.
The complaint says the dentures rendered the food contaminated and unsafe, and that Mr. Rodriguez suffered shock, disgust, nausea, loss of appetite and physical revulsion. (Us, too.)
The suit alleges the driver opened or tampered with the sealed food and “negligently caused her dentures” to become embedded in the sandwich. It also accuses Grubhub of failing to properly screen, supervise, train or monitor delivery workers, and alleges Jersey Mike’s failed to safeguard the sandwich.
Grubhub told USA Today it was troubled by the report and said the driver was no longer contracted with the company.
Mr. Rodriguez is seeking a jury trial.
